Navigating Diversity: Societal Attitudes Towards LGBTQ+ Individuals in Southern African Countries – A Systematic Review of Challenges and Implications for Policy

Abstract

Abstract The legal and social space for lesbian, gay, bisexual, transgender and queer (LGBTQ+) individuals in Southern Africa is characterised by disparities in legal protections, societal attitudes and institutional responses. This chapter examines the challenges and policy implications surrounding LGBTQ+ rights across ten (10) Southern African countries: Angola, Botswana, Eswatini, Lesotho, Malawi, Mozambique, Namibia, South Africa, Zambia and Zimbabwe. Employing Queer Theory as an analytical lens, the study synthesises findings from peer-reviewed research, policy reports and advocacy publications to explore key themes, including legal status, societal attitudes, social stigma, healthcare access and advocacy efforts. Discussion highlights the pervasive influence of religious conservatism and cultural traditions in shaping public perceptions and policy responses towards LGBTQ+ individuals. While countries, such as South Africa, have embraced legal frameworks that protect LGBTQ+ individuals, Zimbabwe, Zambia and Malawi maintain strict anti-LGBTQ+ laws. Other nations, like Botswana and Mozambique, have decriminalised same-sex relationships but continue to face challenges in implementing comprehensive protections. The findings reveal that legal progress alone does not guarantee societal acceptance or equal treatment. Legal protections are undermined by deep-seated homophobia, institutional discrimination and inadequate policy enforcement. Additionally, LGBTQ+ individuals in criminalised environments face heightened risks of violence, social ostracisation and mental health challenges. Despite these challenges, advocacy organisations play a crucial role in promoting legal reforms and social inclusion, often under restrictive conditions. This chapter calls for comprehensive anti-discrimination legislation, legal reforms to decriminalise same-sex relationships, improved healthcare policies and stronger enforcement mechanisms to bridge the gap between legal advancements and lived realities.
