Balancing Public Health and Commercial Speech: The Case for Front-of-Pack Warning Labels

Abstract

Abstract The rising burden of non-communicable diseases (NCDs) has intensified global attention on the commercial determinants of health, particularly the marketing and labelling practices of the food and beverage industry. In South Africa, Draft Regulation R.3337 proposes mandatory front-of-pack warning labels (FOPL) and marketing restrictions on unhealthy foods and beverages, aligning with international standards and WHO guidance. These measures, however, face strong opposition from industry stakeholders who invoke the constitutional right to freedom of commercial speech. This article critically examines whether the Draft Regulation passes constitutional muster under Sect. 16(1) of the Constitution, read with the general limitations clause in Sect. 36. Drawing on comparative jurisprudence from South Africa and abroad, including tobacco and alcohol advertising cases, the paper situates FOPLs within the broader public health and human rights imperative to protect consumers, particularly children, from misleading and harmful marketing. It argues that while commercial speech is protected, it is not absolute and may be reasonably limited to safeguard public health. By anticipating industry challenges, the article provides a constitutional defence of Draft Regulation R.3337, demonstrating that the proposed limitations are proportionate, justifiable, and necessary to advance health equity and reduce the burden of diet-related NCDs in South Africa. The article further argues that although both warning labels and restrictions on persuasive marketing constitute limitations on commercial expression, they engage distinct constitutional concerns and therefore require differentiated proportionality analysis under Sect. 36 of the Constitution.
